That complexity can lead to inaccurate billing, and contract non-compliance with you, as their client.  You do have rights in this situation, but you need to know where to look, and what to look for.  Your company may be eligible for exemptions or refunds of overpayments of tax on access charges and certain telecommunications equipment purchases.</p>

Maybe you’re entering contracts that have auto-renewal clauses, perhaps you’re not making sure that your suppliers are adhering to the agreement, as it was signed and, possibly, you’re not negotiating the best terms for your company.</p>
<p>Below are 3 easy tips that will make it easier for your team to improve its contract management program, and avoid noncompliance.  If you implement these tips, you will lower risk, save money, and build better vendor relationships.</p>
<p><strong>Tip #1: Don’t Enable Auto-Renewal of Contracts, or allow “Evergreen” clauses</strong></p>
<p>It might seem tempting to just allow your contracts to auto-renew. Sounds much easier, right? Instead of renegotiating the contract each time, it can seem more convenient to have it renew on its own.</p>
<p>Often, companies lose money by allowing their contracts to renew automatically. Contracts that contain “evergreen” clauses typically require you to terminate the agreement within a certain amount of time before the contract ends. Sometimes, the timeframe can be anywhere between 30 – 90 days.</p>
<p>Here’s the thing… if you don’t give the vendor notice within that timeframe, your company is obligated to renew for another term, which may not be beneficial to your organization. This is why you should avoid contracts with evergreen clauses.</p>
<p>What if you were able to renegotiate the contract? What if you could get better pricing? Better delivery times? Better payment terms? Entering into an evergreen contract could open you up to the risk of limiting your flexibility.</p>
<p><strong>Tip #2: Conduct Your Own Contract Compliance Audit</strong></p>
<p>If you’re going to have an effective contract management program, you need to audit your vendors. Just like your vendors will want to make sure that you are abiding by the terms of your contract, you need to do the same.</p>
<p>Here’s a few tips:</p>
<p><strong>Determine the Extent of the Audit</strong></p>
<p>First, you need to figure out how extensive your audit will be. Will you audit the whole document, or are you only concerned by one element of the contract?</p>
<p>Determining the extent of your audit will keep you from wasting time because you will know exactly which parts to look at. Of course, if you’re going to audit the whole document, it’s a good idea to make sure that your vendor management organization has the time and resources to devote to this task.</p>
<p><strong>Identify Your Objectives</strong></p>
<p>After you figure out how extensive your audit will be, you must figure out what you’re trying to accomplish with your audit.  What is your end goal is?</p>

<li>Recovering costs (from overpayments).</li>

<p><span style="color: #000000; font-family: Times New Roman; font-size: medium;">So let&#8217;s start with what does flawless mean? I argue it means perfect. So what is perfect?</span></p>
<p><span style="color: #000000; font-family: Times New Roman; font-size: medium;">According to Webster&#8230;</span></p>
<p><span style="color: #000000; font-family: Times New Roman; font-size: medium;"> </span><span style="font-size: medium;"><span style="color: #000000;"><span style="font-family: Times New Roman;"><b>Perfect </b>&#8212; adjective \ˈpər-fikt\</span></span></span></p>
<ol>
<li><span style="color: #000000; font-family: Times New Roman; font-size: medium;">Having no mistakes or flaws</span></li>
<li><span style="color: #000000; font-family: Times New Roman; font-size: medium;">Completely correct or accurate</span></li>
<li><span style="color: #000000; font-family: Times New Roman; font-size: medium;">Having all the qualities you want in that kind of person, situation, etc.</span></li>
</ol>
<p><span style="color: #000000; font-family: Times New Roman; font-size: medium;">And if this is true, what do we compare it to? We would argue average. Not the bottom of the barrel, but what everyone agrees is okay.</span></p>
<p><span style="color: #000000; font-family: Times New Roman; font-size: medium;">So how would one define <b>average</b>?</span></p>

<li><span style="color: #000000; font-family: Times New Roman; font-size: medium;">1. The typical or normal amount, quality, degree, etc.: above average</span></li>
<li><span style="color: #000000; font-family: Times New Roman; font-size: medium;">2. Typically: on average, he goes twice a week.</span></li>
<li><span style="color: #000000; font-family: Times New Roman; font-size: medium;">3. Usual </span></li>
<li><span style="color: #000000; font-family: Times New Roman; font-size: medium;">4. Mediocre or inferior: his performance was only average.</span></li>
<li><span style="color: #000000; font-family: Times New Roman; font-size: medium;">5. Approximately typical of a range of values: the average contents of a matchbox.</span></li>
</ol>
<p><span style="color: #000000; font-family: Times New Roman; font-size: medium;">So, what are you judged on as an Operator? </span><span style="color: #000000; font-family: Times New Roman; font-size: medium;">Average execution, average operations, average cash flows, average P&amp;L, average Management team????</span></p>
<p><span style="color: #000000; font-family: Times New Roman; font-size: medium;">We think not.</span></p>
<p><span style="color: #000000; font-family: Times New Roman; font-size: medium;">No in fact you are judged on being above average, or better than average. And maybe, just maybe, you would prefer to be thought of as an incredible operator, having excellent financials and the being compared to or recognized as the best in the business.</span></p>
<p><span style="color: #000000; font-family: Times New Roman; font-size: medium;">If so&#8230;how do you get there? Well it starts with great people, great services, and great suppliers. Okay, so you hire the right people, provide excellent services, and find great suppliers. Sounds easy right? Well, I believe right now most of you are shaking your head from side to side in a no fashion, saying to yourself &#8220;I wish&#8221;. Why is that? Pretty simple, all great people are great at some things, even great at many things, but are definitely not great at all things. Knowing this is half the battle; implementing a strategy based on this knowledge is not as easy. And it&#8217;s not as easy because we expect flawless execution from employees, service providers, and suppliers (“people”)&#8230;no matter how important their jobs or functions may be.</span></p>
<p><span style="color: #000000; font-family: Times New Roman; font-size: medium;">The question is, do these “people” have the expertise to perform the functions you ask them to?  Were “people” given the training to perform this function, or are they just expected to know everything? Then you have to ask yourself, do you know everything about everything? We believe if answered honestly, you would agree you do not. No human, and yes your “people” are human, knows everything about everything.</span></p>
<p><span style="color: #000000; font-family: Times New Roman; font-size: medium;">So what now? Train everyone about everything in business? Not likely. Train everyone on everything in your business? Better focus, but still not likely. No, you need to educate, train and mentor your employees to be excellent at the function they perform in your business, and also choose partnerships and vendors “people” that have the expertise to truly help drive your business towards a flawless execution. This realization and leadership action develops partners that act like employees and brings their expertise and flawless execution into your business.</span></p>
<p><span style="color: #000000; font-family: Times New Roman; font-size: medium;">If you did this, do you believe you would be a better Operator than your competition? Can you see how this would position you to possibly be flawless?</span></p>

Unplug all your chargers when your not using them &#8211; We know, it is a pain to go around your office and unplug your iPod, Cell Phone, iPad, Lap Top, Electric Shaver, and all those other things your have  plugged-in in your office, but it could make a difference in your energy bill. Every charging device you have in your outlet uses energy regardless of if it is charging a device or not. If everyone in your office building has 5 chargers plugged-in, and you have 100 employees you have 500 chargers wasting energy and increasing your electric bill.</p>
<p>2. Communicate with your employees about being green- one segment about green solutions could really make a difference. One thing businesses do not do as much as they should is talk about orders they give to employees with the employees. Instead of using an email to tell employees to turn off light in their office, tell them directly and explain how it benefits the company and the environment. Employees are more likely to do the obvious green activities if their boss is telling them to do it directly.</p>
<p>3. Buy recycled printer cartridges- Refilling your old cartridges is much cheaper than buying new ones. This is because a large portion of the price you pay is for the canister. This reduces waste because old canisters will go in the trash which will go in a land fill somewhere in the world. Why pay extra for something you already have?</p>
